1. Agreement
These terms govern your access to and use of BAMENOS, a field service management platform, and its website. By creating an account or using the Service, you agree to these terms. If you are using the Service on behalf of a business, you represent that you are authorized to bind that business.
2. Accounts
You must provide accurate, current information when registering and keep it up to date. You are responsible for safeguarding your credentials and for all activity under your account. Notify us immediately of any unauthorized use. Accounts may be individual or belong to an organization; organization owners control their roster, roles, and data.
3. Acceptable use
You agree not to: misuse the Service or attempt to access it in ways outside its intended interfaces; access data belonging to another organization without authorization; reverse engineer or resell the Service without permission; upload malicious code or unlawful content; or use the Service in violation of applicable laws, including consumer protection and employment laws.
4. Your data
You retain all rights to the business and operational data you enter into the Service ("Your Data"). You grant BAMENOS a limited license to store, process, and back up Your Data solely to provide the Service. We may use aggregated, de-identified statistics to improve the platform. Your Data remains yours even after termination, subject to Section 8.
5. Subscriptions and billing
Paid plans are billed monthly in advance and renew automatically until cancelled. Fees are non-refundable except where required by law. We may change fees with reasonable notice; changes apply from your next billing cycle. Overdue accounts may be suspended after notice. Where payments are handled by a third-party processor, their terms also apply to the payment itself.
6. Service availability
We work to keep the Service available and reliable, but the Service may be unavailable for maintenance, outages, or factors beyond our control. Some features may be introduced, changed, or retired over time. Material reductions to a paid plan's core functionality will be communicated before they take effect.
7. Disclaimers
The Service is provided "as is" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. BAMENOS does not warrant that the Service will be uninterrupted or error-free. You remain responsible for the accuracy of data you enter and for the conduct of your business operations.
8. Term and termination
You may stop using the Service and close your account at any time. We may suspend or terminate accounts for material breach of these terms, non-payment, or unlawful use, with notice where practicable. Upon termination by you, Your Data is handled according to our data retention practices, and you may request an export during that window.
9. Limitation of liability
To the maximum extent permitted by law, BAMENOS will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the Service. Our total liability for any claim will not exceed the fees you paid to us in the twelve months preceding the claim.
10. Indemnification
You agree to indemnify and hold BAMENOS harmless from claims and damages arising from Your Data, your use of the Service in violation of these terms, or your violation of any law or third-party right.
11. Governing law
These terms are governed by the laws of the United States and the state in which BAMENOS maintains its principal place of business, without regard to conflict-of-law rules. Disputes will be resolved in the courts of that jurisdiction, unless applicable law provides otherwise.
12. Changes to these terms
We may update these terms as the Service evolves. Continued use after changes take effect constitutes acceptance. If you disagree with a material change, you may cancel before it applies.
